David W. Leimbach

Mr. Leimbach focuses his practice on commercial litigation, representing businesses and individuals in federal and state courts, as well as arbitrations. He takes pride in advocating zealously on behalf of clients and resolving their disputes efficiently.  

Biography

Before joining the firm in 2019, Mr. Leimbach clerked for the Honorable Gregory K. Frizzell in the United States District Court for the Northern District of Oklahoma and for the Honorable Judith C. McCarthy in the United States District Court for the Southern District of New York. He also practiced for several years in New York, where he represented clients in a variety of civil matters in federal and state courts. 

 

Mr. Leimbach received his Juris Doctor from Columbia Law School, where he was a Stone Scholar. He received his Bachelor of Arts, cum laude, in Mathematics and Philosophy from Dartmouth College.

 

Representative Recent Engagements

  • Successfully defended multiple patent-infringement lawsuits in federal courts, obtaining dismissals without clients paying a dime to patent trolls (2024).
  • Successfully prosecuted claims against large insurer for breach of financial institution bond (2024).
  • Successfully defended financial institution against data-breach putative class action in federal court (2023).
  • Successfully prosecuted product-liability claims against device manufacturer (2023).
  • Successfully defended large employer against ERISA putative class action in federal court (2022).
  • Obtained multimillion-dollar settlement in favor of client in contract-based lawsuit in federal court against international franchise company (2021).
  • Helped obtain multimillion-dollar jury verdict in favor of subcontractor in lawsuit arising from large energy construction project, while successfully defending against eight-figure counterclaims (2021).
  • Successfully defended drilling company from wage-and-hour claims in putative collective action in federal court (2021).
  • Helped obtain seven-figure settlement in favor of client bank in lawsuit against insurance company arising from breach of a fidelity bond (2021).
  • Helped obtain eight-figure award in favor of client bank on summary judgment in lawsuit arising from defaulted commercial loans (2020).
